OVIAH LLC (“OVIAH,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you use the OVIAH platform (the “Platform”).

1. Who This Policy Applies To

This Privacy Policy applies to:

  • Beauty professionals who register as Providers on the Platform
  • Clients who book appointments or interact with Provider services
  • Visitors to our website at www.oviah.com

2. Information We Collect

2.1 Information You Provide Directly

We collect information you provide when you register, use the Platform, or contact us, including:

  • Names, email addresses, phone numbers, and mailing addresses
  • Business name and professional information (Providers)
  • Appointment history and booking details
  • Portfolio images and profile photos
  • Communications with OVIAH or other Platform users

2.2 Payment Information

OVIAH does not store your full payment card information. Providers connect their own Stripe or Square account directly to the Platform via Stripe Connect OAuth. Payment transactions are processed by Stripe, Inc. or Square, Inc. under their respective privacy policies. OVIAH may receive limited transaction metadata (e.g., transaction IDs, amounts, and status) for Platform functionality purposes only.

2.3 Information Collected Automatically

When you use the Platform, we automatically collect:

  • IP address and device identifiers
  • Browser type, operating system, and device type
  • Pages visited, features used, and time spent on the Platform
  • Referral URLs

2.4 Information From Third Parties

We may receive information from third-party services you connect to the Platform (e.g., Stripe, Square) to facilitate Platform functionality.

3. How We Use Your Information

We use the information we collect to:

  • Create and manage your account and provide Platform services
  • Facilitate appointment bookings and client management
  • Process subscription billing and communicate about your account
  • Enable Providers to build and publish their website
  • Respond to your inquiries and provide customer support
  • Send transactional notifications such as booking confirmations and reminders
  • Improve, analyze, and develop new Platform features
  • Comply with legal obligations and enforce our Terms of Service
  • Send marketing communications (you may opt out at any time)

4. How We Share Your Information

4.1 With Providers

When a Client books an appointment, we share the Client’s relevant information (name, contact details, and booking details) with the Provider to facilitate the service.

4.2 With Clients

Provider business information, profiles, and availability are visible to Clients to facilitate bookings.

4.3 Service Providers

We share information with third-party vendors who assist us in operating the Platform, including:

  • Cloud hosting and infrastructure providers
  • Payment processors (Stripe, Square)
  • Email and SMS communication providers
  • Analytics providers

These vendors are contractually bound to use your information only as directed by OVIAH and in compliance with applicable law.

4.4 Legal Compliance

We may disclose your information if required by law, regulation, or court order, or to protect the rights, safety, or property of OVIAH, our users, or the public.

4.5 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

4.6 No Sale of Personal Information

OVIAH does not sell, rent, or lease your personal information to third parties for their own marketing purposes.

5. Data Retention

We retain your information for as long as your account is active or as needed to provide services. You may request deletion of your account data at any time (see Section 7). We may retain certain information as required by law or for legitimate business purposes such as fraud prevention.

6. Security

We implement industry-standard technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure. We encourage you to use a strong, unique password for your OVIAH account.

7. Your Rights and Choices

7.1 Access and Correction

You may access and update your account information at any time through your account settings or by contacting us at legal@oviah.com.

7.2 Account Deletion

You may request deletion of your account and associated personal data by contacting us at legal@oviah.com. We will process deletion requests within 30 days, subject to legal retention obligations.

7.3 Marketing Opt-Out

You may opt out of marketing emails at any time by clicking the unsubscribe link in any marketing communication or contacting us directly. Transactional and account-related communications are not subject to opt-out.

7.4 Cookie Controls

You may control cookie preferences through your browser settings. Disabling certain cookies may affect Platform functionality.

8. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to:

  • Maintain your session and authentication state
  • Remember your preferences
  • Analyze usage and improve the Platform
  • Deliver relevant communications

By using the Platform, you consent to our use of cookies as described herein.

9. Children’s Privacy

The Platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, please contact us at legal@oviah.com and we will promptly delete it.

10. Client Data Controlled by Providers

When Providers use OVIAH to manage Client data (such as appointment history, contact information, and photos), the Provider is the data controller for that Client data. OVIAH processes this data on behalf of Providers as a data processor. Providers are responsible for obtaining any necessary consents from their Clients and for complying with applicable privacy laws with respect to Client data they collect through the Platform.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or integrate with third-party services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you use in connection with the Platform.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email or a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after such notice constitutes acceptance of the updated policy.

13. Governing Law

This Privacy Policy is governed by the laws of the State of Michigan.
